Definitions

Account Terms

• ▶ You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We recommend setting up two-factor authentication for added security.
• ▶ You may not use the Service for any illegal purposes or to violate any laws in your jurisdiction.
• ▶ You are responsible for all content created, posted, and activity that occurs under your account, including all games and contests generated through our AI tools.
• ▶ You must be at least 13 years old to use this Service. If you are between 13 and 18, you must have your parent or guardian's permission to use Tilez.ai.
• ▶ You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

AI-Generated Content and Games

• ▶ Our Service uses artificial intelligence to help you generate games and contests. While we strive for quality and appropriateness, AI-generated content may occasionally be unpredictable or inappropriate.
• ▶ You are responsible for reviewing all AI-generated games and contests before using or sharing them with others.
• ▶ You agree not to use our AI tools to generate content that is harmful, offensive, discriminatory, or violates any applicable laws.
• ▶ We reserve the right to refuse generation of or remove any content that violates these terms or our community standards.

Payment, Refunds, and Plan Changes

• ▶ If you are using a free version of our Service, it is really free: we do not ask you for your credit card or sell your data.
• ▶ For paid plans that offer a free trial, we explain the length of trial when you sign up. After the trial period, you need to pay in advance to keep using the Service. If you do not pay, we will freeze your account and it will be inaccessible until you make payment.
• ▶ If you are upgrading from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade. For other upgrades or downgrades in plan level, the new rate starts from the next billing cycle.
• ▶ All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, we will collect those taxes on behalf of the taxing authority. Otherwise, you are responsible for payment of all taxes, levies, or duties.
• ▶ We offer refunds on a case-by-case basis. Contact our support team if you believe you're entitled to a refund.

Cancellation and Termination

• ▶ You are solely responsible for properly canceling your account. You can cancel your account from your account settings page. An email request to cancel your account is not automatically considered cancellation.
• ▶ All of your content will be inaccessible from the Service immediately upon account cancellation. Within 30 days, all content will be permanently deleted from active systems and logs. Within 60 days, all content will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted.
• ▶ If you cancel the Service before the end of your current paid period, your cancellation will take effect immediately, and you will not be charged again. We do not automatically prorate unused time in the last billing cycle.
• ▶ We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Service for any reason at any time, including violations of these Terms.
• ▶ Verbal, physical, written or other abuse of a Company employee will result in immediate account termination.

Modifications to the Service and Prices

• ▶ We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Service with or without notice.
• ▶ Sometimes we change the pricing structure for our products. When we do that, we tend to exempt existing customers from those changes. However, we may choose to change the prices for existing customers. If we do so, we will give at least 30 days notice and will notify you via the email address on record.

Uptime, Security, and Privacy

• ▶ Your use of the Service is at your sole risk. We provide this Service on an "as is" and "as available" basis. We do not offer service-level agreements, but do take uptime seriously.
• ▶ We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers. We'll reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.
• ▶ We take measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet.
• ▶
  We may process your data as described in our Privacy Policy and for no other purpose. On rare occasion, our staff may access your data to:

  • • Help you with support requests (with your express consent)
  • • Fix technical issues that affect automated processes
  • • Safeguard Tilez.ai and ensure security of the Service
  • • Comply with applicable law when legally required

Content Ownership and AI Usage

• ▶ All games and contests you create using our Service belong to you. You retain full ownership of any content you create, whether generated with AI assistance or not.
• ▶ You give us a limited license to use your content as necessary to provide the Service to you, including processing it through our AI systems to generate games and contests.
• ▶
  By using our AI-powered tools, you understand that:

  • • AI models are trained on large datasets that may include publicly available content
  • • Similar prompts may generate similar outputs for different users
  • • We cannot guarantee that AI-generated content will be entirely unique
• ▶ You agree not to use our Service to generate content that infringes on others' intellectual property rights.
• ▶ All right, title, and interest in and to the Tilez.ai platform and Service remain with the Company. You obtain no ownership rights in the Service itself as a result of your use.

Acceptable Use

You agree not to use Tilez.ai to:

• ▶ Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• ▶ Create games or contests that promote violence, discrimination, or illegal activities
• ▶ Attempt to reverse engineer, hack, or exploit our AI systems
• ▶ Generate spam content or use the Service for unsolicited marketing
• ▶ Violate any applicable local, state, national, or international law or regulation
• ▶ Infringe upon the intellectual property rights of others

API Terms (if applicable)

If we offer API access:

• ▶ You expressly understand and agree that we are not liable for any damages or losses resulting from your use of the API.
• ▶ Abuse or excessively frequent requests to the Service via the API may result in temporary or permanent suspension of your account's access.
• ▶ API usage is subject to rate limits and fair use policies.

Liability

You agree that the Company is not liable to you or to any third party for damages of any kind that result from:

• ▶ Use of the Service or inability to access data
• ▶ AI-generated content that may be inappropriate or cause issues
• ▶ Unauthorized access of your data or account
• ▶ Actions of any third party that uses the Service
• ▶ Any other consequences related to these Terms or the Service

The Company's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [YOUR STATE/JURISDICTION], without regard to its conflict of law provisions.
